TERMS AND CONDITIONS OF THE WEBSITE edu4us.org

  1. GENERAL PROVISIONS
    1. The website edu4us.org operates under the terms specified in these Terms and Conditions.
    2. The Terms and Conditions define the types and scope of services provided electronically by the Website, the rules for providing these services, the conditions for concluding and terminating contracts for the provision of electronic services, as well as the complaint procedure.
    3. Each Service Recipient, upon taking actions aimed at using the Electronic Services of the Website, is obliged to comply with the provisions of these Terms and Conditions.
  2. DEFINITIONS
    1. Contact Form – a form available on the Website that allows the Service Recipient to directly contact the Service Provider.
    2. Terms and Conditions – these terms and conditions;

    4. Service Recipient – a natural person, legal entity, or organizational unit without legal personality, which the law grants legal capacity, using the Electronic Service or the Website.
    5. Electronic Service or Service – a service provided electronically by the Service Provider to the Service Recipient via the Website, by phone, or by email, consisting of educational advice regarding starting studies in the USA and Canada, support for the recruitment process to the selected Institutions by the Service Recipient.
    6. Newsletter – an Electronic Service allowing the Service Recipient to subscribe to and receive free information from the Service Provider at the email address provided by the Service Recipient.
    7. Website – edu4us.org
    8. Institution – a higher education institution, university, or other school in the USA or Canada that the Service Recipient intends to apply to with the help of the Service Provider to maximize the chances of the Service Recipient being accepted to the selected university, higher education institution, or other school in these countries.
    9. Application – sending to the Service Provider via email to the mailbox info@edu4us.org a complete set of documentation required by a given Institution to start the recruitment process at that Institution, in a manner enabling the Service Provider to verify the correctness of the submitted documentation and forward these documents to the given Institution, or another agency recruiting students to start the recruitment of the Service Recipient.

3. TYPE AND SCOPE OF ELECTRONIC SERVICES

  1. The Service Provider provides Electronic Services aimed at maximizing the Service Recipient’s chances of being accepted to the selected Institution in the USA or Canada. The Service Provider allows, via the Website:

a) the use of the Contact Form,

b) enabling contact with the Service Provider through social media, phone, email,

c) the use of the Newsletter,

d) the use of the Website by the Service Recipient and user,

e) the use of the Website by the Service Recipient without the need for registration,

f) enabling the Service Recipient to apply to selected Institutions by sending an Application to the Service Provider.

2. The provision of Electronic Services to the Service Recipients is carried out under the conditions specified in the Terms and Conditions.

  1. To the extent that the Terms and Conditions refer to services provided by means of an ICT system, ensuring the processing and storage, as well as sending and receiving data via telecommunications networks in accordance with the Act of 18 July 2002 on the provision of electronic services, the Terms and Conditions constitute the regulations referred to in Art. 8 of this Act.

4. RULES FOR USING THE WEBSITE

  1. The Service Recipient can contact the Service Provider using the Contact Form, by phone, by email, and through social media mentioned on the Website. The Service Recipient can apply to the selected Institution via the Service Provider by contacting the email address info@edu4us.org.
  2. The Service Recipient wishing to contact the Service Provider through the Contact Form is asked to fill in the following data: name, email address, phone number.
  3. The Service Recipient can send their documents necessary for the application process to a given Institution as an attachment in PDF or DOC/DOCX format.
  4. When filling out the Contact Form, the Candidate is asked to:
    a. confirm that they have read the Privacy Policy and these Terms and Conditions by checking the appropriate checkbox. Checking the checkbox regarding reading the Privacy Policy and Terms and Conditions is mandatory for the data to be sent to the Service Provider,
    b. consent to the processing of their personal data. Checking this checkbox is voluntary, but not checking it will result in the necessary personal data for contact not being sent to the Service Provider,
    c. consent to receive marketing information (including commercial information) via electronic communication means (including telephone terminal devices, automatic calling systems) – this consent is voluntary and not required to send contact data to the Service Provider.
  5. By pressing the “Send” button in the Contact Form, the Service Recipient consents (through their action) to educational advice in the application process and the transfer of data to the Institutions they decide to apply to, as well as to other recruiting agencies cooperating with the Service Provider.
  6. The Service Recipient is obliged to include in their application documents only such personal data and other information as is necessary for the application process. Otherwise, the Service Provider reserves the right not to consider the Application.
  7. The contract for the provision of Electronic Services is concluded at the moment the Service Recipient presses the “Send” button in a correctly completed Contact Form, or at the moment of contact with the Service Provider’s email address and leaving personal data analogous to those in the Contact Form.
  8. The contract for the provision of the Service may be terminated by the Service Recipient at any time without giving a reason by contacting the Service Provider by email.
  1. CONDITIONS FOR PROVIDING AND CONCLUDING CONTRACTS FOR ELECTRONIC SERVICES

1. The provision of Electronic Services by the Service Provider is free of charge.

2. The period for which the contract is concluded:

i. the contract for the provision of an Electronic Service is concluded for a specified period and terminates upon the cessation of contact between the Service Recipient and the Service Provider, or upon the Service Recipient’s declaration of resignation from the Electronic Service to the Service Provider’s email address;

ii. the contract for the provision of the Electronic Service consisting of the use of the Newsletter is concluded for an indefinite period.

3. Technical requirements necessary for cooperation with the ICT system used by the Service Provider:

i. a computer with internet access,

ii. access to email,

iii. a web browser,

iv. enabling Cookies and Javascript in the web browser.

4. The Service Provider makes every effort to ensure that the services provided on the Website are of the highest quality and, therefore, does not rule out the possibility of temporarily suspending the availability of the Website in case of the need for maintenance, inspection, replacement of equipment, or due to the necessity of modernization or expansion of the Website. The Service Provider will make every effort to ensure that any suspension of the Website’s availability is carried out at night.

5. The Service Provider informs that the inability to send relevant information to the Service Provider via email despite the due diligence of both the Service Provider and the Service Recipient may result from the blocking of messages by the administrators of email servers to the email address indicated by the Service Recipient or the deletion or blocking of some email messages by software installed on the computer/phone used by the Service Recipient.

6. COMPLAINT PROCEDURE

  1. Complaints related to the provision of Electronic Services by the Service Provider:

i. Complaints related to the provision of Electronic Services via the Website may be submitted by the Service Recipient via email to the address: info@edu4us.org

ii. The above email should include as much information and circumstances as possible regarding the subject of the complaint, in particular, the type and date of occurrence of irregularities and contact details. The provided information will significantly facilitate and accelerate the consideration of the complaint by the Service Provider.

iii. The Service Provider considers the complaint immediately, no later than within 14 days.

iv. The Service Provider’s response regarding the complaint is sent to the Service Recipient’s email address provided in the complaint or in another manner provided by the Service Recipient.

7. SERVICE PROVIDER’S LIABILITY

  1. The Service Provider is not responsible for any actions or omissions of the Service Recipient that may hinder the recruitment process to the Institutions selected by the Service Recipient.
  2. The Service Provider is not responsible for changes: in the course, form, and rules of recruitment and the availability and costs of participating in courses offered by Institutions or other entities; for changes concerning government grants and scholarships offered by entities independent of the Service Provider.
  3. The contract for the provision of Electronic Services is a contract of due diligence, and therefore the Service Provider is not responsible for the outcome intended by the Service Recipient, e.g., obtaining a positive exam result or being accepted to the Institutions selected by the Service Recipient.
  4. The Service Provider is not responsible for technical problems or technical limitations in the computer or mobile equipment of the User that prevent the Application.
  5. The Service Provider is not responsible for third-party rights violations and damages caused to third parties as a result of or in connection with actions taken by the Service Recipient, in particular in case of violation by the Service Recipient of copyrights and other intellectual property rights belonging to third parties.

8. STATEMENTS

  1. Service Recipients using the Website accept that to facilitate the recruitment process, the Service Provider transmits data to Institutions and other agencies recruiting students for foreign studies, including the Service Recipient’s Personal Data in the form provided by the Service Recipient and prepared by the Service Provider. If an Institution or a recruiting agency expresses interest in potentially employing a Service Recipient, the Service Provider promptly informs the Service Recipient by email or phone.
  2. The Service Provider ensures the confidentiality of processed data, their security, and compliance with applicable laws, including GDPR.
  3. After delivering or making available the data, including the Service Recipient’s personal data, to the Institution or another student recruiting agency cooperating with the Service Provider, this entity is obliged to:

i. use the data, including the Service Recipient’s personal data, only for designated purposes;

ii. ensure appropriate technical and organizational security measures;

iii. refrain from further unauthorized disclosure of the Service Recipient’s Personal Data.

9. PROHIBITED CONTENT

  1. The Website cannot be used for unlawful purposes. Therefore, the Service Recipient may not transmit false information through the Website, e.g., regarding their education or experience, or other false or untrue data. They may not post offensive content, slander, threats, vulgarities, content inciting violence, or racial hatred.
  2. Service Recipients, in particular, may not transmit information/data/files:
    • 1) posing a risk to IT security or the stability of the Website;
    • 2) infringing intellectual property rights, including copyrights and trademark rights of the Service Provider or third parties;
    • 3) otherwise violating the mandatory provisions of law and good manners.
  3. Service Recipients using the Website confirm that they will not transmit information/data/files through the Website that:
    • 3.1 contain viruses or other harmful content or materials that may modify, delete, or place unwanted information on the Website;
    • 3.2 may negatively affect the operation of the Website;
    • 3.3 may cause the Website to hang.
  4. Service Recipients undertake not to use any software to hack, suspend, or damage the Website. Service Recipients using the Website confirm that they will not take any actions that may adversely affect the reputation of the Service Provider.
  5. The Service Provider is entitled to remove from the Website information/data/files that violate the above provisions. In each of these cases, the Service Provider will send an appropriate notification to the Service Recipient’s email address.
  6. The Service Provider is not obliged to verify the information/data/files transmitted by the Service Recipients. In the case of receiving an official notification that the information or data of the Service Recipient violates generally applicable laws, the Service Provider is obliged to immediately enable access to this information/data/files to the appropriate persons.

10. INTELLECTUAL PROPERTY RIGHTS

All information contained on the Website constitutes the intellectual property of the Service Provider. All trademarks, logos, software, or other items subject to intellectual property rights are the exclusive property of the Service Provider. The Service Recipient is not authorized to download, copy, or print any content of the Website, except when using it for personal use and provided that they do not change its original form and legally reserved notes. Copying and distributing the Website content for business or advertising purposes is prohibited. Attempting to decrypt, disassemble, or modify the software, encoding information contained on the Website, and placing content that violates intellectual property rights is prohibited.

11. PERSONAL DATA

  1. The administrator of the personal data of the Service Recipients processed within the Website is the Service Provider. Personal data is processed to provide Electronic Services and may be shared with external entities, including Institutions, agencies recruiting students for foreign studies, providers responsible for IT system maintenance, entities providing legal or accounting services, couriers, marketing or recruitment agencies. Personal data may be shared with cooperating entities in the form provided by the Service Recipient and prepared by the Service Provider.
  2. Providing personal data by the Service Recipient and consenting to their processing is voluntary but necessary for the Service Recipient to use Electronic Services.
  3. Consent to the processing of Personal Data within the Website may be withdrawn at any time by the Service Recipient in the form of a statement sent to the email address: info@edu4us.org. Withdrawal of consent is tantamount to resignation from using the Website and the Electronic Services provided by the Service Provider.
  4. Detailed information on the protection of the Service Recipients’ personal data, including their rights and the rules for using cookies, is specified in the Privacy Policy and the Cookie Policy.

12. FINAL PROVISIONS

  1. Contracts concluded via the Website are concluded in accordance with Polish law. Any disputes arising between the Service Recipient and the Service Provider will be resolved by the court competent for the Service Provider’s registered office.
  2. In the event of non-compliance of any part of the Terms and Conditions with applicable law, the relevant provisions of Polish law shall apply in place of the disputed provision of the Terms and Conditions.
  3. These Terms and Conditions are valid indefinitely.
  4. Matters not regulated in these Terms and Conditions are governed by the generally applicable provisions of Polish law, in particular: the Civil Code; the Act on the provision of electronic services; the Consumer Rights Act, the Personal Data Protection Act.
  5. The Service Provider reserves the right to change these Terms and Conditions for a valid reason, such as:

i. the need to adapt the Terms and Conditions to legal provisions directly affecting the Terms and Conditions and resulting in the need to modify the Terms and Conditions to comply with the law;

ii. the need to adapt the Terms and Conditions to recommendations, orders, rulings, resolutions, interpretations, guidelines, or decisions of authorized public authorities;

iii. the expansion or change of the Website’s functionality, including possibly introducing new services provided electronically or changing existing functionalities of the Website;

iv. changes in the technical conditions of providing the Website;

v. the need to eliminate ambiguities, errors, or clerical errors that may occur in the Terms and Conditions;

vi. changes in contact details, names, identification numbers, email addresses, or links contained in the Terms and Conditions

a) The Service Provider will inform about the change of the Terms and Conditions within the Website (by posting an appropriate announcement) and by sending relevant information (along with the amended Terms and Conditions) to the Service Recipients’ email addresses.

b) The amended Terms and Conditions are binding for the Service Recipient who does not submit a statement of resignation from using the Website.
